Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and HeyDazz (“we”, “us”), operated by Heydan. They govern your use of the HeyDazz app. By downloading or using HeyDazz, you agree to these Terms. If you do not agree, please do not use the app.

1. Acceptance of terms

By accessing or using HeyDazz (“the app”), you accept and agree to be bound by these Terms. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old — or the minimum age of digital consent in your country — to use HeyDazz. By using the app, you confirm that you meet this requirement and can enter into these Terms.

3. Licence to use the app

We grant you a personal, limited, non-exclusive, non-transferable, and revocable licence to download and use HeyDazz on any Apple device that you own or control, for your own use, in accordance with these Terms and the Apple App Store Terms of Service.

4. The service

HeyDazz is a mobile app that applies film-style presets and effects to photos you capture or import. All image processing is performed on your device. The app is provided “as is” and “as available.”

5. HeyDazz Pro subscription & payments

HeyDazz Pro is an auto-renewable subscription billed monthly through your Apple Account at the price shown in the app (IDR 29.000 / month). Payment is charged at confirmation of purchase and renews automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel anytime in your App Store account settings. Billing, cancellations, and refunds are handled by Apple in accordance with Apple’s policies; we do not process payments ourselves.

6. Acceptable use

You agree not to use the app for any unlawful purpose, reverse engineer, decompile, or tamper with it, resell or redistribute it or its presets, or use it to create infringing, harmful, or abusive content.

7. Your content

You retain all rights to the photos you create or edit with HeyDazz. We do not claim ownership of your content and do not upload your photos to our servers. You are solely responsible for the content you create and how you use it.

8. Intellectual property

The HeyDazz name, app, presets, and visual design are owned by HeyDazz and protected by applicable law. Except for the licence granted above, you may not copy, modify, resell, or redistribute them without our written permission.

9. Apple and the App Store

These Terms are between you and HeyDazz only, and not with Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app, and any warranty claims, losses, liabilities, damages, costs, or expenses are our responsibility, not Apple’s. Apple is not responsible for addressing any claims by you or a third party relating to the app or your use of it — including product-liability, legal, regulatory, consumer-protection, or intellectual-property claims. You must comply with any applicable third-party terms (including the App Store Terms of Service) when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Disclaimers

The app is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, to the maximum extent permitted by law. We do not warrant that the app will be uninterrupted or error-free.

11. Limitation of liability

To the maximum extent permitted by law, HeyDazz shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of data or profits, arising from your use of the app. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold HeyDazz harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the app or your violation of these Terms or applicable law.

13. Termination

We may suspend or discontinue the app, in whole or in part, at any time. You may stop using the app at any time by uninstalling it. Sections that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — will continue to apply.

14. Governing law

These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law rules. Nothing here limits any mandatory consumer-protection rights you may have under the laws of your country of residence.

15. Severability & entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. Together with our Privacy Policy, these Terms are the entire agreement between you and HeyDazz regarding the app.

16. Changes to these terms

We may update these Terms from time to time. We will indicate changes by updating the “Last updated” date above. Continued use of the app after changes take effect constitutes acceptance.
